USER AGREEMENT OF THE PUNISHERSHOP ONLINE PLATFORM

This User Agreement (hereinafter – "Agreement") is an official offer addressed to visitors and customers of the website: https://punishershop.com.ua/ (hereinafter – the "Website" and/or "Online Platform"), governing the use of the platform's services during browsing, ordering, correspondence, or telephone communication.

1. General Provisions and Acceptance

1.1. This Agreement constitutes a public offer under the provisions of the current legislation of Ukraine.

1.2. Engaging in any activity on the Website (including browsing, registration, placing an order, or leaving reviews) is considered an unconditional acceptance (acceptance) of all provisions of this Agreement.

1.3. The User acknowledges that acceptance of this Agreement is equivalent to signing a formal contract under the terms set forth herein.

1.4. If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

2. Definitions

  • Online Platform – A marketplace featuring an assortment of various sellers, facilitating the sale of goods and services to Buyers.

  • Administrator/Owner – The entity or persons authorized to manage the Online Platform and provide services to Users. The Owner acts as a provider of intermediary information services under the Law of Ukraine "On Electronic Commerce."

  • User – A collective term for Sellers, Buyers, and Visitors who have agreed to the terms of this Agreement.

  • Content – Protected results of intellectual activity uploaded by Users, including but not limited to: item names, descriptions, photographs, specifications, advertising materials, and reviews.

  • Account/Personal Cabinet – The User’s personal electronic interface within the platform used to manage services and orders.

3. Rights and Limitation of Liability

3.1. The Platform Owner is not a party to the electronic transactions between the Seller and the Buyer. All agreements are concluded directly between the parties.

3.2. The Administration provides the technical communication platform but is not responsible for:

  • The quality, safety, or legality of the goods/services offered by Sellers;

  • The accuracy or completeness of the Content provided by Users;

  • The fulfillment of warranty or delivery obligations by the Sellers;

  • Any direct or indirect damages, including lost profits or data, arising from the use or inability to use the services.

4. User Obligations

4.1. Provide accurate, complete, and up-to-date information during registration or order placement.

4.2. Use the Website only for lawful purposes, respecting the intellectual property rights of the Owner and third parties.

4.3. Refrain from any actions that disrupt the normal operation of the Online Platform, including the use of automated devices (bots, scrapers, or crawlers) to access or copy content.

4.4. Commercial copying of information from the Website without the Administration's explicit consent is strictly prohibited.

5. Amendments and Termination

5.1. The Administration of https://punishershop.com.ua/ reserves the right to modify this Agreement without prior notice. The current version is always available at: https://punishershop.com.ua/privacypolicy/.

5.2. Continued use of the platform after changes are posted constitutes the User's consent to the revised terms.

5.3. If a User disagrees with any terms, they must immediately cease using the Online Platform and terminate their relationship with the service.

6. Personal Data and Microsoft Clarity

6.1. By accepting this Agreement, the User consents to the processing of their personal data as outlined in the Privacy Policy.

6.2. To improve user experience, the Website uses Microsoft Clarity to collect anonymous behavioral data (clicks, scrolls, mouse movements).

7. Force Majeure

7.1. The Administration shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to: war, strikes, natural disasters, utility failures, or government acts.

Acceptance of this Agreement ensures a transparent and secure interaction for all participants of the PunisherShop platform.
